The rules that govern your use of bananaakw.com and every order you place with us. Please read them before you buy, because they form a binding agreement between you and Bananaa Kuwait.

01 Accepting these terms

These Terms and Conditions govern your access to and use of bananaakw.com and any purchase you make through it. By browsing the site, creating an account, or placing an order, you confirm that you have read, understood, and agreed to be bound by these terms.

If you do not agree with any part of them, please do not use the site or place an order. These terms should be read together with our Privacy Policy and our Refund & Return Policy, which form part of the same agreement.

Your statutory rights come first. Nothing in these terms removes or reduces any right given to you by Kuwaiti law, including Consumer Protection Law No. 39 of 2014 and Decree-Law No. 10 of 2026 regulating the digital commerce sector. Where a term here conflicts with those laws, the law prevails.

03 Eligibility & accounts

To place an order you must be at least 18 years old and legally capable of entering into a binding contract. Orders placed by minors require the involvement of a parent or legal guardian.

Your account

  • You may browse without an account, but checkout requires accurate contact and delivery details
  • You are responsible for keeping your password confidential and for all activity under your account
  • Tell us immediately if you suspect unauthorised use of your account
  • We may suspend or close an account used for fraud, abuse, or repeated breaches of these terms, and will explain why when we do

You agree that the information you give us is true, current, and complete, and that you will keep it up to date. Incorrect delivery details are the most common cause of failed deliveries, and we cannot be responsible for orders sent to an address you entered incorrectly.

04 Products & descriptions

We sell electronics, mobile and IT accessories, photo and video gear, smart gadgets, and premium desk and lifestyle accessories. We describe every product as accurately as we can, including specifications, compatibility, and what's in the box.

  • Images are illustrative. Colours can appear differently between screens, and packaging or minor design details may be updated by the manufacturer without notice.
  • Availability is not guaranteed until confirmed. Stock levels change quickly, and an item in your cart is not reserved until your order is accepted.
  • Genuine products only. We source from authorised distributors and importers. We do not sell counterfeit or replica goods.
  • Errors happen. If we discover a material error in a description or specification after you order, we will contact you and give you the choice to continue or cancel for a full refund.

05 Pricing & currency

All prices are shown in Kuwaiti Dinar (KWD) and include any applicable taxes unless stated otherwise. Delivery charges, where they apply, are shown separately and confirmed before you complete checkout, so the total you see at the final step is the total you pay.

We may change prices at any time, but a change never affects an order we have already accepted. If a product is listed at an obviously incorrect price because of a technical or human error, we are not obliged to supply it at that price. We will contact you, explain the error, and let you either confirm at the correct price or cancel for a full refund.

06 How an order is formed

  1. You place the orderAdding items to your cart and completing checkout is an offer to buy, not yet a contract.
  2. We acknowledge itYou receive an automatic confirmation that we've received your order. This is a receipt, not an acceptance.
  3. We accept itThe contract is formed when we confirm the order has been accepted and dispatched. At that point we send your electronic invoice.
  4. We may declineWe can decline an order if the item is out of stock, the price was listed in error, we cannot verify your details, or we suspect fraud. If we decline after you've paid, we refund you in full.

07 Payment

We accept KNET, major credit and debit cards, and cash on delivery where offered. Payment methods are provided through licensed payment providers that comply with Central Bank of Kuwait regulations.

  • We do not charge you any additional fee for choosing one electronic payment method over another
  • We never store your full card number, CVV, or KNET PIN. These are handled directly by the payment gateway
  • Payment must clear before dispatch, except for cash-on-delivery orders
  • If a payment is reversed, charged back, or fails after dispatch, we may recover the amount or the goods

08 Invoices

Once your order is accepted we send you an electronic invoice in Arabic, with an English version alongside it. The invoice sets out the product price, the total price including all fees, the delivery date and location, and the payment method used. Please keep it, as it is your proof of purchase for returns, refunds, and warranty claims.

09 Delivery

We deliver across Kuwait. Estimated delivery times are shown at checkout and are estimates rather than guarantees, since they depend on stock location, courier schedules, and customs clearance on imported items.

  • Someone must be available at the delivery address to receive the order
  • Risk in the goods passes to you on delivery; ownership passes once payment has cleared in full
  • If delivery is materially delayed, we will tell you promptly and you may cancel for a full refund
  • Repeated failed delivery attempts caused by incorrect details or unavailability may result in the order being returned to us and a redelivery charge

Please inspect your order on arrival. Report visible transit damage as soon as possible, ideally within 48 hours, so we can raise it with the courier.

10 Returns & cancellation

You have the right to withdraw from your purchase within 14 days of receiving it and receive a full refund through your original payment method, at no additional cost, provided the item is returned in its original condition. Certain categories are excluded by law, including used items, custom-made goods, completed digital downloads, and activation codes.

11 Warranty

Products carry the manufacturer's warranty stated on the product page, commonly 12 to 24 months for the electronics brands we stock. Warranty covers manufacturing defects and normal-use failures. It does not cover physical or liquid damage, unauthorised repairs or modifications, or ordinary wear and tear.

Separately from any manufacturer warranty, we remain responsible under Consumer Protection Law No. 39 of 2014 for repairing, replacing, or refunding defective products within the stated guarantee period or, where none is stated, within a reasonable customary period.

12 Promotions, discounts & vouchers

  • Promotions run for a stated period and while stocks last
  • Discount codes are single-use per customer unless stated otherwise, cannot be exchanged for cash, and cannot be combined unless we say so
  • Discounted items carry exactly the same return and refund rights as full-price items
  • We may withdraw or amend a promotion at any time, but never for orders already accepted
  • We may cancel orders where a code has been obtained or used fraudulently or in bad faith

13 Acceptable use of the site

You agree to use bananaakw.com lawfully and not to:

  • Attempt to gain unauthorised access to the site, its servers, or any account
  • Introduce malware, or interfere with the site's operation or security
  • Scrape, copy, or systematically extract content or product data for commercial use
  • Place fraudulent or speculative orders, or resell in breach of any stated purchase limit
  • Post unlawful, misleading, offensive, or infringing content anywhere on the site

Misuse may be a criminal offence under Law No. 63 of 2015 on Combating Cyber Crimes, and we will report it where appropriate.

14 Intellectual property

The Bananaa name, logo, site design, original photography, and written content are owned by us or licensed to us, and are protected under Kuwaiti and international intellectual property law. You may view and print pages for your own personal, non-commercial use.

You may not reproduce, republish, or use our content commercially without our written permission. Third-party brand names, logos, and product images remain the property of their respective owners and appear here solely to identify the products we sell.

15 Reviews & your content

If you post a review, rating, question, or image, you confirm it is your own honest content and does not infringe anyone's rights. You grant us a non-exclusive, royalty-free licence to display, reproduce, and use that content in connection with our store and its promotion.

We may remove content that is unlawful, abusive, misleading, off-topic, or posted to promote a competing business. We do not publish fabricated reviews, and we do not remove genuine negative reviews simply because they are unfavourable.

16 Third-party links

Our site may link to manufacturer pages, delivery tracking, payment providers, or social platforms. We do not control those sites and are not responsible for their content, availability, or privacy practices. Following an external link is at your own discretion, and that site's own terms will apply.

17 Liability

We take responsibility for supplying products that match their description and are free from defects, and for handling your order with reasonable care and skill.

To the fullest extent permitted by Kuwaiti law, we are not liable for indirect or consequential loss, loss of profit, loss of data, or loss arising from use of a product contrary to the manufacturer's instructions. Where we are found liable, our total liability in connection with an order will not exceed the amount you paid for that order.

Nothing in this section limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded under Kuwaiti law.

18 Events beyond our control

We are not in breach of these terms where performance is prevented or delayed by events outside our reasonable control, including customs delays, port or shipping disruption, courier strikes, extreme weather, power or network failure, or government action. If such an event materially affects your order, we will notify you promptly and you may cancel for a full refund.

19 Privacy

How we collect, use, share, and protect your personal data is set out in our Privacy Policy. We apply appropriate technical and organisational security measures and follow the cybersecurity requirements applicable to digital commerce in Kuwait, updating our systems as threats evolve.

20 Complaints & disputes

If something goes wrong, contact us first. We operate a transparent complaint process, keep records of complaints for at least six months, and aim to give you a substantive reply within 3 working days.

If we cannot resolve the matter between us, you may escalate it to the Ministry of Commerce and Industry (MOCI), including the digital commerce dispute settlement committee, which handles disputes between online sellers and consumers in Kuwait.

21 Changes to these terms

We may update these terms to reflect changes in our operations or in Kuwaiti law. The effective date at the top of this page always shows the current version. The terms that apply to your order are the ones in force at the time you placed it, so a later change never applies retroactively to an accepted order.

22 Governing law & jurisdiction

These terms are governed by the laws of the State of Kuwait, including Consumer Protection Law No. 39 of 2014, Decree-Law No. 10 of 2026 regulating the digital commerce sector, Law No. 20 of 2014 on Electronic Transactions, and Law No. 63 of 2015 on Combating Cyber Crimes. Any dispute not resolved directly or through MOCI's committees is subject to the exclusive jurisdiction of the competent courts of Kuwait.

If any provision of these terms is found invalid or unenforceable, the remaining provisions continue in full effect.
