How Bananaa Kuwait collects, uses, and protects your personal data when you shop with us online — in plain language, and in line with Kuwait's data protection framework.
01 Introduction
Bananaa Kuwait ("Bananaa," "we," "us," or "our") operates bananaakw.com, an online store for electronics, mobile accessories, and premium desk and lifestyle accessories. This Privacy Policy explains what personal data we collect when you browse or buy from us, why we collect it, who we share it with, and the choices and rights available to you under Kuwaiti law.
By using our website, placing an order, contacting us, or otherwise sharing your information with us, you acknowledge that you have read and understood this policy. If you do not agree with any part of it, please do not use the website or submit your data to us.
02 Who we are
Bananaa Kuwait is the data controller responsible for your personal data collected through this website. Our registered contact details are provided at the end of this policy under Contact Us. For any privacy-related question, that is the fastest way to reach us.
03 Information we collect
We collect only what we need to run the store, fulfil your orders, and improve your experience. Depending on how you interact with us, this may include:
Account & order information
- Full name, phone number, and email address
- Delivery address(es) and, where relevant, billing address
- Order history, product preferences, wishlist and cart contents
- Civil ID or ID details only where required for high-value deliveries or customs purposes, and only as far as necessary
Payment information
- Payment method selected (KNET, credit/debit card, or cash on delivery)
- Transaction confirmation and status
- We do not store your full card number, CVV, or KNET PIN on our servers — these are handled directly and securely by our licensed payment gateway
Browsing & device information
- IP address, browser type, device type, and operating system
- Pages viewed, time spent, referring website, and general location (city/country level)
- Cookies and similar technologies — see Cookies
Communications
- Messages you send us via WhatsApp, phone, email, or contact forms
- Reviews, ratings, or feedback you choose to submit
04 How we use your information
We use your personal data to:
- Process, confirm, and deliver your orders, including coordinating with couriers and customs where goods are imported
- Provide customer support and respond to enquiries or complaints
- Process payments and prevent fraud
- Send order updates, delivery notifications, and service messages
- Send marketing messages about new arrivals, offers, or restocks — only where you have opted in (see Marketing & WhatsApp)
- Improve our website, product range, and shopping experience through aggregated analytics
- Meet our legal, tax, accounting, and consumer-protection obligations in Kuwait
We do not use your data for any purpose incompatible with the reasons it was collected, and we do not sell your personal data to third parties.
05 Legal basis & consent
We collect and process personal data on the following bases:
- Consent — for example, when you create an account, subscribe to marketing, or accept cookies
- Performance of a contract — to process and fulfil the order you placed with us
- Legal obligation — such as retaining invoices for tax purposes under Kuwaiti commercial law
- Legitimate interest — for example, fraud prevention and improving site security, balanced against your right to privacy
Where processing relies on your consent, you may withdraw it at any time, free of charge, without affecting the lawfulness of processing carried out before withdrawal.
08 International transfers
Some of our products are sourced and shipped from overseas suppliers, and some of our service providers (such as cloud hosting or analytics tools) may process data outside Kuwait. Where personal data is transferred internationally, we take reasonable steps to ensure it receives a comparable level of protection, including using providers with recognised security standards and limiting the data shared to what is necessary for the specific purpose (for example, a delivery address for a shipment).
09 Data retention
We keep personal data only for as long as needed for the purpose it was collected, including:
- Order and transaction records — retained in line with Kuwaiti commercial and tax record-keeping requirements
- Account information — retained while your account is active, and for a reasonable period after closure to handle any warranty, return, or legal claims
- Marketing consent — retained until you unsubscribe or withdraw consent
When data is no longer required, we securely delete or anonymise it.
10 Keeping your data secure
We use appropriate technical and organisational measures to protect your personal data against unauthorised access, loss, misuse, or alteration, including encrypted checkout, restricted internal access, and secure hosting. No online system can be guaranteed 100% secure, but we work to keep our safeguards current and to respond quickly to any incident.
11 Your rights
In line with Kuwait's data protection framework, you have the right to:
| Right | What it means |
|---|---|
| Access | Ask us what personal data we hold about you and why |
| Correction | Ask us to correct inaccurate or incomplete data |
| Deletion | Ask us to delete your data where it is no longer needed or you withdraw consent |
| Withdraw consent | Opt out of marketing or withdraw any consent-based processing at any time |
| Object | Object to processing based on legitimate interest, including profiling |
| Complain | Raise a concern with us directly, or with the relevant Kuwaiti regulator |
To exercise any of these rights, contact us using the details in Contact Us. We may need to verify your identity before actioning certain requests, and we will respond within a reasonable time.
12 Marketing messages & WhatsApp
If you opt in to receive offers and updates by SMS, WhatsApp, email, or phone, we will only send commercial messages between 7:00 AM and 10:00 PM Kuwait time, and we will always verify we're messaging the right person before sending marketing communications. You can unsubscribe or opt out at any time by replying "STOP," using the unsubscribe link in our emails, or messaging us directly — we will action this promptly and keep a record of your preference.
13 Children's privacy
Our store is intended for adults able to enter into a binding purchase. We do not knowingly collect personal data from individuals under 18 without the consent of a parent or legal guardian. If you believe a minor has provided us with personal data without appropriate consent, please contact us so we can remove it.
14 Changes to this policy
We may update this Privacy Policy from time to time to reflect changes in our practices or in Kuwaiti law. The "Effective date" at the top of this page will always show the latest revision. We encourage you to review this page periodically, and where changes are material, we will take reasonable steps to notify you.
15 Governing law
This policy, and any dispute relating to it, is governed by the laws of the State of Kuwait, including Law No. 20 of 2014 on Electronic Transactions, Law No. 63 of 2015 on Combating Cyber Crimes, and applicable consumer protection and data privacy regulations issued by the Communication and Information Technology Regulatory Authority (CITRA) and the Ministry of Commerce and Industry. Any disputes that cannot be resolved directly with us are subject to the exclusive jurisdiction of the competent courts of Kuwait.
